The Agenda for August 22nd includes an item on the NPDES General Permit for wastewater discharges from single family residents. Dan McLawhorn has been closely involved with this process, particularly in regard to the action that the Division of Water Quality has taken in renewing this permit and the Falls Lake Rules. Because of extensive concerns about DWQ’s recent decision to renew this permit, the City of Raleigh has filed a contested case. Attached as background, please find the filing for a contested case, the motion for stay of the permit pending the resolution of the case and EPA’s comments on DWQ’s permit. The motion document provides a good background on the case and the comment letter reflects the EPA’s view of the DWQ action. Dan will provide a briefing to the Board next Wednesday.
